Final Transfer of Ownership (December 1, 1800)

Document 6, titled Concept Cammeral:Kaufbriefs, is the final instrument in the case. It serves in place of a formal, sealed deed of sale (Kaufbrief) and officially transfers ownership of the purchased parcels to Jobst Heinrich Krückeberg, No. 10 in Berenbusch, and his heirs.

Following Krückeberg’s petition (Document 1) and the subsequent approvals and conditions set forth in earlier Rescripts and reports (Documents 2–5), the Comital Guardianship Treasury Office (Gräflich vormundschaftliche Rentkammer) confirms:

  • Two parcels on the village street were formally assigned and sold to Krückeberg for the enlargement of his garden and courtyard.

  • The parcels had been measured by a sworn land surveyor:

    • Garden expansion — 19 rods 44 feet (decimal)

    • Courtyard area — 1 rod 90 feet (decimal)

  • The purchase price, calculated at 24 Mariengroschen per square rod, was paid in full:

    • 14 Reichsthaler, 8 Mariengroschen, 1 Pfennig to the Comital Treasury.

  • Krückeberg assumes responsibility for annual ground rent (Rottzins), contributions, and both ordinary and extraordinary levies, to be entered in the Amt Bückeburg’s accounts on schedule.

  • The document assures Krückeberg and his heirs that their possession of the parcels will be legally protected against all parties.

The document is dated Bückeburg, December 1800, and issued under the impressed comital guardianship treasury seal with signatures of the appointed directors and councillors: Gladbeck, von Landesberg, Maas, Windt, and Wippermann. It was dispatched by Beÿer.

Berenbusch über einen Platz zur Vergrößerung seines Gartens.

Nachdem auf Ansuchen des Colons Jobst Heinrich Krückeberg Nr. 10 zu
Berenbusch, Amts Bückeburg, von Gräfl. vormundschaftl. Rentcammer
bewilliget worden, daß demselben zur Vergrößerung seines Gartens und
Hofraums zweÿ in der Dorfstraße belegene Plätze ausgewiesen, und
dergestalt käuflich überlaßen werden sollen, daß er jede Quadrat: Rute mit
24 Mariengroschen zu bezahlen habe;

und hiernächst diese Plätze durch einen beeidigten Landmeßer, und zwar
ersterer zur Vergrößerung seines Gartens zu neunzehn Ruten 44 Fus dec: und
der andere zum Hofraum zu einer Rute 90 Fus dec: gros ausgemeßen, auch das
Kaufgeld nach dem bestimten Preise mit vierzehn Rthlr 8 ugln 1 d an Gräfln
Cammercasse erleget worden;

wobeÿ gedachter Colon Krückeberg verpflichtet ist den von bemeldeten
beiden Plätzen angesetzten Rottzins und Kontribution, auch sowohl
gewöhnliche als außerordentliche Abgaben zu übernehmen und jährlich zu
gehörne Zeit in die Rechnungen des Amts Bückebürg richtig abzutragen;

So wird dem Colon Jobst Heinrich Krückeberg Nr: 10 zu Berenbusch und deßen
Erben das Eigenthum dieser von ihm erkauften Platze himit übergeben und
die Versicherung ertheilet, daß er und seine Erben bey deren Besitz
jederzeit und gegen Jedermann geschützet werden sollen.

Deßen zur Urkund ist dieses statt Kaufebriefs unter beÿ gedruckten Gräfl.
vormundschaftln Cam̅ersiegel und gewöhnlicher Unterschrift ausgefertiget
worden. So geschehen Bückeburg d. 1 December 1800.

concerning a plot for enlarging his garden.

At the request of tenant holder Jobst Heinrich Krückeberg, No. 10 in
Berenbusch (district of Bückeburg), the Comital Guardianship Treasury
Office granted permission for him to enlarge his garden and courtyard.
Two plots on the village street were assigned to him for purchase, at the
price of 24 Mariengroschen per square rod.

A sworn land surveyor measured the parcels:

the first, for the garden, at 19 rods and 44 feet (decimal)

the second, for the courtyard, at 1 rod and 90 feet (decimal)

The total purchase price, according to the set rate, amounted to 14
Reichsthaler, 8 Mariengroschen, and 1 Pfennig, which was paid into the
Comital Treasury.

Krückeberg is obliged to pay the annual ground rent and contributions
assessed on these two parcels, together with both ordinary and
extraordinary taxes, and to settle them each year in the accounts of the
Bückeburg Office.

Ownership of the purchased plots is hereby transferred to Jobst Heinrich
Krückeberg and his heirs, with the guarantee that they shall be protected
in their possession at all times and against all claims.

As proof, this document — issued in place of a formal purchase deed — has
been executed under the impressed Comital Guardianship Treasury seal and
customary signature.
